TERMS OF SERVICE

1. ELIGIBILITY

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you meet this requirement and that you are legally capable of entering into a binding agreement.

2. DESCRIPTION OF THE APP

Traki is a mobile application designed to help truck drivers and related professionals generate invoices by scanning and processing documents provided by the user. The App does not require user account creation.

You understand and agree that:

• Traki generates invoices based solely on the information you provide.
• You are responsible for reviewing all generated invoices for accuracy before use or submission.
• Traki does not verify the legality, correctness, or compliance of any invoice with tax, regulatory, or contractual requirements.

3. NO PROFESSIONAL ADVICE

The App is provided for convenience only and does not constitute legal, accounting, tax, or financial advice. You are solely responsible for ensuring that your invoices comply with all applicable laws, regulations, and contractual obligations.

4. SUBSCRIPTIONS, FREE TRIALS, AND BILLING

4.1 Subscription Model

Traki is offered on a subscription basis through the Apple App Store and/or Google Play Store. Subscription management is handled by the platform provider and RevenueCat.

4.2 Free Trial

Your subscription may begin with a 3-day free trial. If you do not cancel before the end of the free trial period, your subscription will automatically convert to a paid monthly subscription, and you will be charged the applicable subscription fee.

4.3 Auto-Renewal

Subscriptions automatically renew on a monthly basis unless canceled at least 24 hours before the end of the current billing period.

4.4 Payment and Cancellation

All payments, billing, cancellations, and refunds are handled by the platform from which you downloaded the App (Apple or Google). Traki does not control or process payments directly.

You may manage or cancel your subscription through your device's subscription settings.

4.5 No Refunds from Traki

Traki does not issue refunds directly. Any refund requests are subject to the policies of the applicable app store.

5. CAMERA, PHOTOS, AND DATA INPUT

The App requires access to your device's camera or photo library to allow you to scan documents. You grant Traki permission to process images you provide solely for the purpose of generating invoices and improving App functionality.

You represent that:

• You have the right to upload and use any documents or images provided.
• The documents do not infringe the rights of any third party.
• You are responsible for the content and accuracy of all submitted materials.

6. ANALYTICS

Traki uses analytics tools to understand App usage, improve performance, and enhance the user experience. These tools do not change your ownership of your data. For details on how data is handled, please refer to our Privacy Policy.

7. INTELLECTUAL PROPERTY

All rights, title, and interest in and to the App, including but not limited to software, designs, text, graphics, logos, and trademarks, are owned by Traki LLC or its licensors.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract source code, except where permitted by law

8. ACCEPTABLE USE

You agree not to:

• Use the App for unlawful purposes
• Interfere with or disrupt the App or its servers
• Attempt to bypass security or usage limitations
• Use the App in a way that could damage Traki's systems or reputation

9. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAKI DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT GENERATED INVOICES WILL BE ACCURATE OR ACCEPTED BY THIRD PARTIES.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAKI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

IN NO EVENT SHALL TRAKI'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. TERMINATION

We reserve the right to suspend or terminate access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms or if required by law.

You may stop using the App at any time by canceling your subscription and uninstalling the App.

12. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to conflict of laws principles.

13. CHANGES TO THESE TERMS

We may update these Terms from time to time. Updated Terms will be effective upon posting within the App or on our website. Continued use of the App after changes constitutes acceptance of the updated Terms.
